Powell, Dan Farmer, and Matthew Archibald, may be copied, such that the Copyright Holder maintains some control over the development of the package, while giving the users of the package the right to use and distribute the Package in a more-or-less customary fashion, plus the right to make reasonable modifications.

Neither Sun Microsystems Inc., EarthLink Networks Inc., or any other institution or companies bear any liability or responsibility whatsoever for the software, including (but not restricted to) responsibility for its existence, structure, content, function or use by any person anywhere.


License agreement & lack of warranty

 You may not sell Titan  nor sell any of the functionality it provides.
 No part of Titan may be used as part of any commercial product or service
 without having first obtained a commercial licence from Team Titan.

The software, graphics and documentation which make up Titan are Copyright
(c) 1997-2001 by Brad Powell, Matt Archibald, and Dan Farmer. You agree to
respect these rights and leave all notices and product references intact.

3. REDISTRIBUTION

This software may not be redistributed without prior written permission from
Team Titan. You may make coppies for your own use, but not redistribute.

1. You may make and give away verbatim copies of the source form of the Standard
Version of this Package without restriction, provided that you duplicate all of the original
copyright notices and associated disclaimers.

2. You may apply bug fixes, portability fixes and other modifications derived from the Public Domain or from the Copyright Holder. A Package modified in such a way shall still be considered the Standard Version.

3. You may otherwise modify your copy of this Package in any way, provided that you insert a prominent notice in each changed file stating how and when AND WHY you changed that file, and provided that you do at least ONE of the following:

License reference

Titan is distributed under license.

If you don't intend to charge for the software, charge for services using
Titan or include Titan in a product or service offerings, then you don't
need a commercial license. In fact most users don't.
In short:

 * You can't sell Titan or the services it provides. You need a commercial
   license for that.

 * You can't redistribute the code in whole or in part without permission.

 * You need a commercial license if you manage Titan for your customers.
   Initial installation and setup is OK.

 * You're required to buy a commercial license if you intend to use it to
   do monitoring for your customers.

So if you'd like to charge users for Titan useage, or include Titan in whole
or in part as part of a product or service, or on a CD, it's as simple as
dropping a note to titan@fish.com. We'll get back to you right away.

However, if your company is happy with Titan then consider obtaining a
commercial license or a support contract, or make a donation to one of
the charities we recommend!

Why better than free

Because we believe fair is better than "free".

If you want to commercially profit from Titan, you can. You're free to negotiate
and purchase anything you want and distribute the results under the license of
your choice. We're willing to help.

However, once money gets involved, we can make sure it does more than just buy
software. When we sell any commercial license, 10% of that license fee will be
donated to the charity of your choice, on your behalf. As a demographic, those
involved in software are probably least in need of charity, and best positioned
to be of assistance.

So if money is involved, we'll sell our software at a fair price and do it in
such a way that those who really need help get help. That's fair. That's better
than free.

Definitions:

"Package" refers to the collection of files distributed by the Copyright Holder, and derivatives of that collection of files created through textual modification, or segments thereof.

"Standard Version" refers to such a Package if it has not been modified, or has been modified in accordance with the wishes of the Copyright Holder.

"Copyright Holder" is whoever is named in the copyright or copyrights for the package.

"You" is you, if you're thinking about copying or distributing this Package.
