Someone may want to contact the Federal Trade Commission.  Unless the product
was CLEARLY marked "AS-IS" it probably is covered by the universial consumer
code or other implied warranty.  I noticed these drives at our local Computer
City store and they said they  were identical except for packaging.  I didn't
buy one, but if I did, I would have a case.  (Also the attorney General's
office in your and NEC's state might be interested).  Since I am not a lawyer
I cannot speak exactly on these matters, but I have had similar consumer
problems in the past, and there are a number of legal protections if you know
what to do.
